Zohran Mamdani Pledges to Arrest Netanyahu if Elected New York Mayor

In a bold and highly controversial statement, Zohran Mamdani, the Democratic nominee for New York City mayor, said he would instruct the city’s police department to arrest Israeli Prime Minister Benjamin Netanyahu should he ever travel to New York, citing an international criminal court warrant issued in November 2024. Mamdani, who is running in the upcoming November 4 election, framed the pledge as part of his commitment to uphold international law and ensure that New York City stands as a city that respects global justice.

Mamdani, a democratic socialist and current state assemblyman, told the New York Times that he considers Netanyahu a war criminal responsible for genocide in Gaza during Israel’s military campaign. He emphasized that if he were to become mayor, he would act on the ICC arrest warrant, instructing authorities to detain Netanyahu upon arrival in New York. “This is something that I intend to fulfill,” Mamdani said, reiterating his earlier pledge. “It is my desire to ensure that this be a city that stands up for international law.”

While the statement has drawn significant attention, legal experts have questioned the feasibility of Mamdani’s plan. In New York, the mayor does have authority over the police commissioner, but the federal government maintains jurisdiction over international affairs and diplomacy. Experts cited by the New York Times described arresting Netanyahu as a “practical impossibility,” noting that such an action could create a direct confrontation between the city and the federal government. The United States is not a party to the International Criminal Court and does not recognize its authority, which is based in The Hague, Netherlands. In 2024, former President Donald Trump even issued economic sanctions against the ICC, asserting that the court lacked jurisdiction over the United States or Israel.

Netanyahu himself appeared unconcerned about Mamdani’s statement. In July, during a meeting with Donald Trump, Netanyahu said he was “not concerned” about the potential arrest. He indicated that he might travel to New York with Trump and suggested that the situation would unfold if it came to that. Trump, speaking alongside Netanyahu, warned Mamdani to “better behave – otherwise, he’s going to have big problems,” a comment reflecting the political tensions such a move could provoke.

New Yorkers themselves have expressed mixed opinions on the issue. Recent polling indicates a growing support for Palestinians in the conflict with Hamas, though the city is also home to one of the largest Jewish communities in the world, second only to Israel. The polling suggests that while Mamdani’s statement may resonate with certain constituencies, it is likely to spark strong reactions and controversy within the city’s diverse population.

In terms of the mayoral race, Mamdani currently holds a significant lead over his opponents. A recent Emerson College poll, conducted in collaboration with PIX11 and The Hill, showed Mamdani leading former New York governor Andrew Cuomo by 15 percentage points with less than two months to go before the election. Cuomo, who lost the Democratic primary in June, is running as an independent, and the race also includes Republican candidate Curtis Sliwa and incumbent mayor Eric Adams, who is likewise running as an independent. The poll indicates a competitive race for New York City’s highest office, with Mamdani emerging as a frontrunner.

Political analysts have noted that the mayoral race could have implications beyond city politics. Reports indicate that advisers to Trump, a New York native and Republican, are seeking to shape the election to favor a two-candidate contest between Mamdani and Cuomo. Strategies reportedly include offering potential presidential administration roles to Adams and Sliwa, possibly removing them from the spotlight and simplifying the contest for the Democratic nominee.

Mamdani’s promise to act on the ICC warrant underscores his campaign’s broader focus on social justice, international law, and accountability. It also illustrates the challenges a city mayor could face when addressing issues that intersect with global politics and diplomatic relations. While some voters may view the pledge as a principled stand against perceived war crimes, others may see it as largely symbolic due to the limited legal power a city mayor has over international figures.

The candidate’s focus on global justice also fits within a larger campaign narrative in which Mamdani emphasizes equity, human rights, and challenging systemic structures of power. His platform has gained traction among younger voters, progressive communities, and those advocating for international human rights.
